REVIEW UJRAH PADA AKAD IJARAH JASA RENTAL MOBIL PERSKETIF FIQH MUAMALAH (Analisis Pada Fatwa Nomor 56/DSN-MUI/V/2007)

AbstrakPerkembangan bisnis rental mobil syariah memunculkan berbagai isu terkait penerapan akad ijarah, khususnya dalam aspek penetapan ujrah dan perlindungan para pihak yang terlibat. Penelitian ini bertujuan menganalisis implementasi akad ijarah pada bisnis rental mobil berdasarkan Fatwa DSN-MUI Nomor 56/DSNMUI/III/2006 dengan perspektif fiqh muamalah, serta mengkaji solusi atas permasalahan yang sering muncul dalam praktiknya. Menggunakan metode penelitian kualitatif dengan pendekatan normatif-empiris, studi ini menganalisis sumber primer berupa fatwa DSN-MUI dan literatur fiqh muamalah, serta data lapangan dari praktik rental mobil syariah. Hasil penelitian menunjukkan beberapa isu krusial seperti penetapan ujrah yang berkaitan dengan komponen biaya tambahan, sistem deposit, pertanggungan risiko, dan penyelesaian wanprestasi memerlukan kerangka penerapan yang sesuai prinsip syariah. Kesimpulannya, implementasi akad ijarah dalam rental mobil membutuhkan standardisasi yang komprehensif meliputi aspek akad, operasional, dan perlindungan konsumen dengan tetap memperhatikan keseimbangan hak dan kewajiban para pihak berdasarkan prinsip syariah.

Abstract
The development of the sharia car rental business raises various issues related to the implementation of ijarah contracts, especially in the aspect of determining ujrah and protecting the parties involved. This study aims to analyze the implementation of ijarah contracts in the car rental business based on DSN-MUI Fatwa Number 56/DSNMUI/III/2006 with the perspective of fiqh muamalah, as well as examine solutions to problems that often arise in practice. Using a qualitative research method with a normative-empirical approach, this study analyzes primary sources in the form of DSN-MUI fatwa and muamalah fiqh literature, as well as field data from sharia car rental practices. The results of the study show that several crucial issues such as the determination of ujrah related to the additional cost component, the deposit system, risk insurance, and the settlement of defaults require an application framework in accordance with sharia principles. In conclusion, the implementation of the ijarah contract in car rental requires comprehensive standardization including aspects of contracts, operations, and consumer protection while still paying attention to the balance of rights and obligations of the parties based on sharia principles.
