ANALISIS AKAD JUAL BELI RUMAH SISTEM PERANTARA PERSPEKTIF FIKIH MUAMALAH

Abstrak
Jual beli rumah sistem perantara merupakan salah satu bentuk kegiatan yang umum terjadi dalam transaksi ekonomi modern. Namun praktiknya akad ini memunculkan sejumlah persoalan, terutama yang berkaitan dengan Keabsahan hak dan kewajiban, keabsahan akad, dan keadilan masing-masing pihak, baik penjual, pembeli maupun perantara. Penelitian ini dilakukan di Desa Pulau Panggung Kecamatan Pulau Panggung Kabupaten Tanggamus Lampung. Tujuan penelitian ini adalah untuk mengalisis akad jual beli rumah sistem perantara dalam Perspektif fikih Muamalah. Penelitian ini adalah penelitian kualitatif dengan pendekatan fikih muamalah. Pengumpulan data dengan cara wawancara dan dokumentasi. Praktik jual beli rumah sistem perantara di Desa Pulau Panggung Kecamatan Pulau Panggung Kabupaten Tanggamus tidak sesuai dengan konsep akad dalam fikih muamalah. Dimana perantara seharusnya hanya memasarkan rumah namun dalam praktiknya menjadi penjual rumah, yang sejatinya bukan milik perantara. Hal lain juga tidak adanya transparansi harga, perantara menaikkan harga jual rumah tanpa sepengetahuan pemilik, yang mengakibatkan adanya unsur Penipuan dan ketidakjelasan dalam akad. Hal ini tidak lepas dari keterbukaan informasi akad dalam jual beli sistem perantara. Oleh karena itu, sistem perantara diperbolehkan namun harus dilakukan dengan prinsip kejujuran, keadilan, dan tanpa manipulasi harga agar terhindar dari unsur penipuan dan ketidakjelasan yang dapat membatalkan akad.

Abstract
Buying and selling houses through an intermediary system is a common activity in modern economic transactions. However, in practice, this contract raises a number of issues, especially those related to the validity of rights and obligations, the validity of the contract, and the fairness of each party, both the seller, the buyer, and the intermediary. This research was conducted in Pulau Panggung Village, Pulau Panggung District, Tanggamus Regency, Lampung. The purpose of this study was to analyze the house buying and selling contract using an intermediary system from the perspective of Islamic jurisprudence (Fiqh Muamalah). This research is a qualitative study with a Fiqh Muamalah approach. Data collection was carried out through interviews and documentation. The practice of buying and selling houses using an intermediary system in Pulau Panggung Village, Pulau Panggung District, Tanggamus Regency does not comply with the concept of the contract in Islamic jurisprudence (Fiqh Muamalah). Where the intermediary is supposed to only market the house, in practice, it becomes the seller of the house, which does not actually belong to the intermediary. Another thing is the lack of price transparency, the intermediary increases the selling price of the house without the owner's knowledge, which results in elements of fraud and ambiguity in the contract. This is inseparable from the transparency of contract information in intermediary sales systems. Therefore, intermediary systems are permitted, but must be implemented with the principles of honesty, fairness, and without price manipulation to avoid elements of fraud and ambiguity that could invalidate the contract.
