PERLINDUNGAN KONSUMEN TERHADAP JUAL BELI MELALUI MARKETPLACE FACEBOOK PERSPEKTIF MAṢLAHAH MURSALAH

Abstrak
Penelitian ini membahas perlindungan konsumen dalam transaksi jual beli melalui Facebook Marketplace ditinjau dari perspektif maslahah mursalah. Marketplace ini semakin diminati masyarakat karena kemudahan akses dan biaya yang relatif rendah. Namun, lemahnya sistem regulasi menimbulkan potensi kerugian konsumen, seperti penipuan, barang tidak sesuai, dan tidak adanya mekanisme penyelesaian sengketa yang memadai. Metode penelitian yang digunakan adalah penelitian normatif-yuridis dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa regulasi perlindungan konsumen di Indonesia, khususnya dalam transaksi online, masih belum optimal. Dalam perspektif maslahah mursalah, perlindungan konsumen merupakan kebutuhan daruriyyah untuk menjaga harta dan kemaslahatan masyarakat. Oleh karena itu, diperlukan regulasi yang lebih jelas dan tegas terkait mekanisme perlindungan konsumen pada transaksi melalui platform digital seperti Facebook Marketplace.

Abstract
This study examines consumer protection in buying and selling transactions via Facebook Marketplace from the perspective of maslahah mursalah. This marketplace is increasingly popular due to its ease of access and relatively low costs. However, a weak regulatory system creates the potential for consumer losses, such as fraud, non-conforming goods, and the absence of adequate dispute resolution mechanisms. The research method used is normative-juridical research with a legislative and conceptual approach. The results indicate that consumer protection regulations in Indonesia, particularly in online transactions, are still suboptimal. From the perspective of maslahah mursalah, consumer protection is a daruriyyah (essential) requirement to safeguard property and the public interest. Therefore, clearer and more stringent regulations are needed regarding consumer protection mechanisms in transactions via digital platforms like Facebook Marketplace.
