Abstrak
Politik Hukum Pendelegasian Kewenangan Perizinan Berusaha Penambangan Pasir dan Batuan dalam Perspektif Otonomi Daerah. Tujuan dalam penelitian ini ialah menganalisis politik hukum pendelegasian kewenangan perizinan berusaha penambangan pasir dan batuan dalam perspektif otonomi daerah, menganalisis penyelenggaraan pendelegasian kewenangan perizinan berusaha penambangan pasir dan batuan. Jenis penelitian yang digunakan dalam kajian ini adalah penelitian hukum normatif mencakup penelitian terhadap prinsip-prinsip dasar yang tertuang dalam Pancasila, Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan hukum nasional dengan menggunakan pendekatan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa politik hukum pendelegasian kewenangan perizinan penambangan pasir dan batuan telah bergeser secara fundamental dari paradigma desentralisasi (otonomi penuh) menuju paradigma sentralisasi kewenangan substansi (kontrol pusat), di mana fungsi Pemerintah Daerah kini direduksi menjadi pelaksana teknis dan administratif. Penyelenggaraan pendelegasian kewenangan perizinan berusaha penambangan pasir dan batuan yang diimplementasikan melalui mekanisme delegasi kepada Gubernur belum sepenuhnya selaras dengan prinsip otonomi daerah. kiranya Pemerintah Pusat (Kementerian ESDM & Kemendagri) dapat merevisi Peraturan Presiden (Perpres) 55/2022 atau peraturan teknis terkait untuk memperjelas batas kewenangan gubernur sebagai kepala daerah otonom dan wakil pemerintah pusat di daerah. Pemerintah Pusat (Kementerian ESDM dan Kementerian Investasi/BKPM), dapat meningkatkan Kualitas Verifikasi Teknis dan Pengawasan di tingkat daerah agar sesuai dengan NSPK Pusat, sehingga mengurangi kesenjangan kualitas antara Pusat dan Daerah.

Abstract
The Legal Politics of Delegating Licensing Authority for Sand and Rock Mining Businesses in the Perspective of Regional Autonomy. The purpose of this study is to analyze the legal politics behind the delegation of licensing authority for sand and rock mining businesses within the framework of regional autonomy, as well as to examine the implementation of such delegated authority. This research employs a normative legal method, encompassing an examination of fundamental principles contained in Pancasila, the 1945 Constitution of the Republic of Indonesia, and national laws, using statutory and conceptual approaches. The findings indicate that the legal politics of delegating mining business licensing authority for sand and rock extraction have undergone a fundamental shift from a decentralization paradigm (full autonomy) toward a paradigm of centralized substantive authority (central control), wherein the role of Regional Governments has been reduced to technical and administrative executors. The implementation of delegated licensing authority for sand and rock mining businesses through delegation to Governors has not been fully aligned with the principles of regional autonomy. It is recommended that the Central Government (the Ministry of Energy and Mineral Resources and the Ministry of Home Affairs) revise Presidential Regulation No. 55 of 2022 or related technical regulations to clarify the boundaries of gubernatorial authority as both autonomous regional heads and representatives of the central government. The Central Government (the Ministry of Energy and Mineral Resources and the Ministry of Investment/BKPM) should also enhance the quality of technical verification and supervision at the regional level to align with national standards (NSPK), thereby reducing disparities in quality between the central and regional governments.
